关于《律师事务所设立申请登记表》的填写。申请人应如实填写申请登记表;章程粘贴;省辖市司法局初审意见一栏要加盖各市司法局公章并经主管律师工作的副局长签字同意。
关于“拟设律师事务所章程”。章程应当包括以下内容:
(1)律师事务所的名称和执业场所
(2)律师事务所的宗旨
(3)律师事务所的组织形式和机构设置
(4)律师会议的组成和职责
(5)律师事务所负责人的职责以及产生和变更程序
(6)律师的权利和义务
(7)开办资金的数额和来源
(8)财务管理制度、分配制度和债务承担方式
(9)律师事务所变更、终止的条件和程序
(10)律师事务所章程的修改程序
(11)其他要说明的事项
关于“律师事务所地址及住所证明”。属于购房的,提供房产证或契税证明,属于租房的,提供租房协议和房产证明。
关于“申请人辞职文件及无业证明”。辞职文件为原工作单位人事部门同意其辞职的正式文件或解除劳动合同关系的协议原件及复印件;无业证明须提交申请人户籍所在地乡镇、街道办事处出具的无业证明的原件。
关于“申请人的人事档案存放证明”。申请人需提供当地人才交流中心出具的人事关系档案管理合同、档案收据、收费票据的原件及复印件。
关于“拟设律师事务所验资报告”。设立资金执行河南省司法厅下发的豫司文[2008]265号文的文件要求,并由会计师事务所出具验资报告。
关于“申请人提供申报材料真实性保证书”。必须有申请人签名。
关于“申请人无违法违纪证明”。申请人提供本人符合法定条件,且申请设立前三年内未受过停止执业处罚的说明,并加盖拟设律师事务所所在地的市司法局律管部门的印章。
关于“xx市司法局实地勘查报告”。省辖市司法局应实地勘查拟设律师所的办公场所及办公机具,办公场所应适宜律师执业,具备律师执业办公区、业务洽谈区、财务室、档案室等功能分区;办公机具也应配备电脑、复印机、打印机、传真机、电话等,实物资产应符合相关规定。
关于“备用名称”:律师事务所的名称必须符合司法部《律师事务所名称管理办法》的要求,提供备用名称5个。
